In these terms and conditions, the following definitions apply:

  • Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
  • Ongoing Contract: A distance contract concerning a series of products or services, with obligations spread over time.
  • Right of Withdrawal: The consumer’s option to withdraw from the distance contract within the cooling-off period.
  • Entrepreneur: The natural or legal person offering products or services remotely to consumers.
  • Distance Contract: A contract concluded between the entrepreneur and the consumer using remote communication techniques.
  • CESOP: The Central Electronic System of Payment Information introduced by the EU to monitor payment service providers.

2. Identity of the Entrepreneur

Trading Name: ForeverSaint
Legal Entity: DS MEDIA AGENCY LTD
Company Registration Number: 16477640
Customer Service Email: support@foreversaint.com
Registered Address: 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom

3. Applicability

These general terms and conditions apply to every offer by the entrepreneur and every concluded distance contract. Before the agreement is finalized, the terms are made available electronically or otherwise.

4. The Offer

Product offers and prices are displayed on the website. The entrepreneur may correct obvious errors before acceptance, subject to applicable consumer law.

The checkout displays the price and shipping charges payable to the entrepreneur. For qualifying direct-import DAP shipments, import VAT, customs duties and carrier clearance fees may be charged separately upon importation and are not included unless expressly stated. Customers will be informed clearly before ordering that such additional charges may apply.

5. The Agreement

The agreement is established once the consumer accepts the offer and complies with the specified terms. The entrepreneur will confirm acceptance immediately via email.

6. Right of Withdrawal

Consumers entitled to a statutory right of withdrawal may withdraw within 14 days after receiving the goods, without giving a reason, subject to applicable legal exceptions.

Consumers bear direct return-shipping costs when exercising the right of withdrawal only if informed of this before purchase. Statutory rights relating to defective or non-conforming goods remain unaffected.

7. Costs in Case of Withdrawal

Where the consumer exercises a statutory right of withdrawal, the entrepreneur will reimburse the amounts required by applicable law within 14 days of being informed of the withdrawal. The entrepreneur may withhold reimbursement until the goods are received back or the consumer supplies evidence of return, where legally permitted.

The consumer may inspect goods as necessary to establish their nature, characteristics and functioning; any lawful deduction for diminished value may apply.

8. Customs, Import Duties, and VAT Liability

8.1 Delivery Terms

For orders expressly identified before purchase as direct-import shipments under Delivered at Place (DAP), Incoterms® 2020, goods are dispatched from outside the destination customs territory. The customer may be responsible for import clearance, import VAT, customs duties and carrier handling charges payable on importation, subject to applicable law. Not every order or destination necessarily uses this model; the delivery and tax arrangement communicated at checkout applies.

8.2 Import Charges

Where DAP direct-import shipping applies, additional amounts may include:

  • Import VAT, customs duties or other applicable import taxes.
  • Reasonable customs brokerage or carrier clearance fees.
  • Requirements imposed by the destination country.

These charges, where applicable, are generally collected by customs authorities or carriers, not by ForeverSaint. Any applicable mandatory disclosures and consumer rights remain unaffected.

8.3 Importer and Transfer of Risk

For a genuine DAP direct-import shipment, import clearance is intended to take place in the customer’s name or on the customer’s behalf, to the extent permitted by local law. Risk of loss or damage to consumer goods transfers only when the consumer or their nominated third party takes physical possession, except where mandatory law provides otherwise. This clause does not alter mandatory VAT, customs or consumer-law obligations of the seller.

8.4 Shipping Documentation

The entrepreneur will arrange for appropriate shipping and customs documentation and will take reasonable steps to ensure accurate declarations. The entrepreneur remains responsible for obligations imposed on it by applicable law. Customers should check any special import restrictions applicable to their destination.

8.5 Customer Cooperation

Customers must provide accurate delivery information and reasonably cooperate with lawful customs clearance requests. Nothing in these terms requires consumers to indemnify the entrepreneur for the entrepreneur’s own legal obligations or removes statutory rights to delivery, withdrawal, refunds or remedies.

8.6 Import Information

For orders shipped under DAP, customers are advised to review potential import taxes and clearance charges before placing an order. If additional charges are expected, they will be disclosed clearly before checkout to the extent required by applicable law.

9. CESOP Compliance

Payment service providers may report qualifying cross-border payment data under applicable CESOP rules. This does not alter the consumer’s rights or create additional payment obligations.

10. Conformity and Warranty

The entrepreneur ensures that the products meet the agreement and legal requirements.

Consumers retain all mandatory statutory rights and remedies for goods that are defective or do not conform to the contract. Customers are encouraged to report issues promptly, but no contractual notification period reduces mandatory rights.

Original packaging is helpful for processing returns but is not an absolute condition for exercising statutory rights.

11. Delivery

Orders will be delivered within the agreed delivery period, or, where no period has been agreed, within 30 days unless applicable law provides otherwise.

If delivery is delayed, the entrepreneur will notify the consumer and comply with applicable rights to additional time, cancellation and reimbursement.

For shipments clearly designated DAP before purchase, the customer may need to complete import formalities and pay applicable import charges, as described in Article 8.

The entrepreneur remains responsible for delivery and statutory consumer remedies to the extent required by applicable law, including where goods are lost or damaged in transit.

Where a customer refuses lawful import charges that were properly disclosed before purchase, the consequences will be assessed under applicable law. This does not automatically extinguish the consumer’s statutory rights.

12. Complaint Resolution

Complaints may be submitted in writing to the customer service email. Customers are encouraged to contact us promptly after discovering an issue; mandatory statutory rights are not subject to a seven-day complaint deadline.

The entrepreneur will respond to complaints within 14 days. If a longer resolution time is required, the entrepreneur will provide an estimated timeline.

13. Disputes

These terms are governed by the laws of England and Wales, without depriving consumers habitually resident in another country of mandatory protections applicable under that country’s law. Disputes will preferably be resolved amicably. Consumers retain any mandatory rights to bring proceedings before the competent courts under applicable jurisdiction rules.
